You should follow these terms and conditions while you are using ByTheWay (BTW) which connects passengers and hosts to travel to a specified destination. These terms and conditions are exclusively applicable for any service that BTW has to offer through our Mobile App. By agreeing to these terms and conditions you are prohibited to use BTW app for any unlawful or illegal purposes. You have to strictly agree to and follow these terms and conditions to use BTW services which otherwise will prohibit you from any of our services.

For passengers

1.1 Service
- 1.1.1

BTW provides a platform for passengers and owners (Hosts) with vehicles to gather and organize trips to certain destinations. BTW does not provide any transport services. It is only a platform that users can use to connect with Hosts available to travel.

1.1.2

The users should know that BTW is not liable for any unlawful and illegal acts committed by any of the hosts or passengers. Therefore when you agree to these terms and conditions, you are responsible for your actions.

1.1.3

Always use your own Mobile phone number when you are registering with our services and keep your details updated with our platform.

1.2 Operation
- 1.2.1

Users should always use accurate information to sign up with BTW and provide all the required data through the app. After gathering all the information required, we will give you access to an account to use our services.

1.2.2

Do not provide your BTW account for others to operate as passengers, and also, you can’t transfer it if you are not using it anymore.

1.2.3

You should not use the BTW app in any way that is harmful to both the other passengers and hosts. Such as using the app for fake listings or pranks to disturb the hosts and their trips.

1.3 Liability
- 1.3.1

BTW is not liable for any losses suffered by the users financially or emotionally while using our services due to late pickups or arrivals.

1.3.2

The passenger should not hold BTW accountable for any losses or damages caused by the hosts due to the inability to find a ride at a certain time required by the passenger.

1.3.3

The passenger can only cancel the listing one day before the trip, and if you are unable to join multiple times or ignore the booked rides, your account may face severe penalties or even termination.

1.3.4

If the passenger is not at the pickup location, the host has the ability to leave them after waiting for over 10mins without any contact.

1.4 Reimbursements
- 1.4.1

We are not liable for any type of reimbursements you require from us due to any financial losses you receive. Or for rides you think are unsatisfactory while you are using our services.

1.5 Payment
- 1.5.1

The passenger pays the due amounts recorded in the meter after arrival at their destination. And the trip fare will be displayed both on passenger and host screens.

1.5.2

Currently, all transactions are cash payments. Therefore by agreeing to these terms and conditions, you are not allowed to pay your due amounts in any form of credit or debit cards.

1.6 Software
- 1.6.1

By agreeing to the terms and conditions, the passenger agrees that they are using the BTW app at their own will and accepts any issue or risk that will come with the app while using it.

1.6.2

BTW will not be able to provide a guarantee that the services will be available 24/7 without any interruptions to our services. That can get caused by multiple issues such as server, connectivity, or GPS issues.

1.6.3

With the agreement to these terms and conditions, BTW will not be responsible for any damages or issues caused for your mobile phones while you are using our software.

1.6.4

The users should always update the app when there are updates available through the relevant platforms of apple and android to keep the latest software version installed.

1.7 Security
- 1.7.1

Always use our services according to the laws and regulations put forth by the Sri Lankan government to avoid any unlawful and illegal activities. If the users do not comply with these laws, their BTW account will get terminated instantly.

1.7.2

BTW is against any type of sexual harassment and strictly prohibits them while you are using our platform. So if you are hindering or harassing any of the other passengers regardless of their age or gender, you will face severe penalties while also resulting in the termination of your account.

1.7.3

We strictly prohibit any type of alcohol or drug use while you are using our services. And if you are unable to conduct yourself according to these conditions, your account will get terminated.

1.7.4

Always use our SOS button if you are in any danger to contact your primary contact and let them know your location. And this is the only way we can help you to secure your safety. But we are not liable for any threats regarding you while using our services. Therefore always try to secure your own safety first or avoid these situations as a whole while contacting the police or your emergency contacts.

1.8 Competence
- 1.8.1

Always act with competence and discipline when you are traveling with other passengers in the vehicle without invading their privacy.

1.8.2

Do not leave your personal trash inside the vehicle when you are exiting after reaching the destination and always remember to carry them with you.

1.8.3

Do not steal any belongings that are not yours inside the car when you are traveling on a shared ride.

1.9 Discontinuation
- 1.9.1

As a passenger, if you are unable to abide by these above clauses, we have the sole power within our privileges to discontinue the services for you and permanently terminate you from the BTW App. Therefore you won’t be able to register for our services in the future.

For Hosts

2.1 Transport
- 2.1.1

The hosts should have a valid Sri Lankan driving license to use our services through the BTW app. You are not allowed to register with any type of temporary license you received with our platform.

2.1.2

The hosts should always maintain a good vehicle condition without any issues that follow all the laws and the regulations imposed by the Department of motor traffic on your vehicle.

2.1.3

They should always carry passengers according to the seats available in their vehicle. By agreeing to these terms and conditions, the hosts should not carry more passengers in their vehicle than the assigned amount.

2.1.4

Hosts should always follow all traffic laws and regulations imposed by the Sri Lankan government to make the ride safer while avoiding accidents due to misconduct.

2.1.5

You should always try to take the fastest and safest route to your destination with your passengers on board

2.1.6

Do not make multiple stops after you pick up your passengers while you are traveling to your destination. Unless there are any unavoidable situations like a car breakdown or an accident.

2.1.7

As a host, you have the sole privilege of accepting or denying requests from passengers while choosing the specific ones who will travel with you to a certain destination.

2.1.8

As a host, you won’t be able to cancel a listing with passengers after you posted it in the BTW App. But the passenger can cancel their listing from their side.

2.2 Operation
- 2.2.1

Hosts should always use accurate information to sign up with BTW and provide all the required data through the app. After gathering all the information required, we will provide you access to a unique account to use our services.

2.2.2

Do not provide your BTW account for others to operate as hosts, and also, you can’t transfer it if you are not using it anymore.

2.2.3

You should not use the BTW app in any way that is harmful to both the passengers and hosts. Such as using the app for fake listings or pranks to disturb the passengers and mislead them to miss their rides.

2.3 Liability
- 2.3.1

BTW is not liable for any losses suffered by the hosts financially or emotionally while using our services due to late pickups or arrivals.

2.3.2

BTW will not be liable for any vehicle damages caused by the hosts when they are traveling. And also, the same goes for 3rd party damages caused by the hosts if they were in an accident.

2.3.3

By agreeing to these terms and conditions, you should acknowledge as hosts that BTW does not hold any responsibility if any passengers miss your ride or avoid you.

2.4 Commission
- 2.4.1

By agreeing to these terms and conditions, you have to pay 10% of commissions to BTW for all your rides listed with our App. Deposit the due amounts to our bank account to enjoy our services without any interruptions. And if you are unable to pay within a certain period of time, we will take necessary legal actions against you for fraud and theft.

2.5 Payments
- 2.5.1

By agreeing to these terms and conditions, you are required to charge the amount displayed in the app and should not overcharge your passengers with different prices.

2.5.2

By agreeing to these terms and conditions, you have to transfer the due amounts to your bank account when you reach 1000 Rs. In commissions due or pay them within two weeks for our services to be available for you without interruption.

2.5.3

As hosts, you should always directly deposit or transfer the money to our accounts because we don’t take any card payments or cash as payments for our services.

2.6 Competence
- 2.6.1

By accepting our terms and conditions, we prohibit you from provoking or harassing passengers while they travel in your vehicle.

2.6.2

You should always treat your passengers with respect and should not invade their privacy while they are in your vehicle.

2.6.3

As hosts, they should always conduct themselves with competence and act professionally toward their passengers and avoid any kind of conflict with them.

2.6.4

You should keep the personal and valuable belongings that get left behind by the passengers with you until they come back for them or give them to authorities if you are unable to contact them.

2.7 Software
- 2.7.1

By agreeing to the terms and conditions, the Host agrees that they are using the BTW app at their own will and accepts any type of issue or risk that comes with the app while using it.

2.7.2

With the agreement to these terms and conditions, BTW will not be responsible for any damages or issues caused for your mobile phones while you are using our software.

2.7.4

The users should always update the app when there are software updates available through the relevant platform.

2.8 Security
- 2.8.1

2.82

BTW is against any type of sexual harassment and strictly prohibits them while you are using our platform. So if you are hindering or trying any type of harassment to any of the other passengers regardless of their age or gender, you will face severe penalties while also the termination of your account.

2.8.3

We strictly prohibit any type of alcohol or drug use while you are using our services, and if you are unable to conduct yourself according to this condition, your account will get terminated.

2.9 Discontinuation
- 2.9.1

As a host, if you are unable to abide by these above clauses, we have the sole power within our privileges to discontinue the services for you and permanently terminate you from the BTW App. Therefore you won’t be able to register yourself or your vehicle for our services in the future.

Covid Policy

Please follow the instructions below to reduce the risk of exposure to COVID-19 in these hard times to protect yourself and your loved ones. Always remember to act accordingly to this policy when you are using the ByTheWay (BTW) services through our APP.

For passengers

Please take the following Precautions when you are traveling with BTW to ensure your safety and everyone around you in this Covid-19 situation.

Wash or use sanitizer before you enter the vehicle and after you exit
Always remember to wear a facemask properly
Follow proper etiquette while coughing or sneezing like using a tissue or your elbow, and properly dispose of them later without leaving them in the vehicle.
Do not use our services if you have covid like symptoms and please take necessary measures to get medical attention.
Do not try to onboard passengers who are close to you that did not book our services while traveling.

For Hosts

Please take the following Precautions when you are hosting a ride with BTW to ensure your safety and your passengers in this Covid-19 situation.

If you have any covid like symptoms please refrain from hosting trips and seek medical attention immediately.
Always clean your vehicle with disinfectants after each trip to keep your vehicle cleaner and germ free.
Always require all your passengers to wear masks properly inside your vehicle.
Wash or use sanitizer before you enter the vehicle and after you exit.
Try to provide sanitizers for your passengers while always keeping a bottle of sanitizer nearby in the vehicle
